This Privacy Policy explains what information Konita Games LLC, a Kentucky limited liability company (“Konita Games,” “we,” “us,” or “our”), collects through Don't Be Late!, our website (dontbelategame.com), and related products and services (together, the “Service”), and how we use, share, and protect it. Because children use the Service, we have tried to write this in plain language. This Privacy Policy is part of our Terms of Use, and words we define there (“Teacher,” “School or Program,” “Parent,” “Student”) mean the same thing here.
1. Who This Policy Covers
This policy applies to everyone who uses the Service: Teachers, Schools and Programs, Parents, and Students. Section 6 explains how we handle children's information, and Section 7 explains how we work with Schools and Programs.
2. Information We Collect
Account information.
- Name. Students provide a first name and last initial. We do not collect Students' full last names.
- Email address and password, used to sign in. Emails only apply to non-Student accounts. Student accounts don’t have emails. Passwords are handled by Firebase Authentication, and we cannot read them.
- Role (Teacher or Student), the School or Program code, and, for Students, the class code.
Gameplay and learning information.
- Questions answered, whether each answer was correct, accuracy, time spent playing, and hints used.
- Results for each level and chapter, star ratings, current level, and the dates a Student was last active.
- Coins, achievements, characters, and daily login rewards and streaks.
Teacher and class information.
- Class names, grade levels, class join codes, and the list of Students in each class.
Messages you send us.
Support messages can be sent from Teacher, Parent, and School or Program accounts. If you contact support through the app, we receive your subject and message, your email address, your school name and class code, the app version, and your device model and operating system, so we can help you.
Privacy requests.
If you request a copy or deletion of information, we keep a record of the type of request and the date.
Information stored on your device.
Your sign-in token, your saved email address for non-Students, your account ID, your sound, music, and explanation settings, and a local copy of your progress and rewards so the game works smoothly.
Technical information.
Our cloud provider may automatically log basic technical information, such as an IP address, when a device connects to our servers. The game engine we build on (Unity) may also collect limited technical and device information, as described in Unity's privacy policy.
What we do not collect.
We do not collect precise location, photos, videos, audio recordings, contacts, government ID numbers, or payment card details. The Service does not include chat, messaging between users, or public profiles.
3. How We Use Information
We use information to:
- Create and run accounts, and let people sign in.
- Save progress, coins, and rewards, and keep them in sync across sessions.
- Show Teachers how their Students are doing.
- Respond to support messages and privacy requests.
- Keep the Service secure, prevent cheating and abuse, and fix bugs.
- Improve the Service, including its questions, levels, and reports.
- Meet legal obligations.
We do not use personal information to show advertising, and we do not build advertising profiles.
4. Who Can See Student Information
- Teachers. A Teacher can see information about the Students in that Teacher's own classes through the Class Analytics dashboard, including names, accuracy, questions answered, hints used, session time, last active date, and results by chapter and level.
- Schools and Programs. A School or Program may have access to information about its own Students as described in Section 7.
- Other Students. Students cannot see other Students' information.
- Us. A small number of Konita Games personnel and contractors may access information as needed to run the Service, provide support, and keep it secure.
5. How We Share Information
We share information only in these ways:
- Service providers. We use trusted providers to run the Service: Google Firebase for sign-in and cloud database hosting, and EmailJS to deliver the support messages you send us. They may use information only to provide their services to us.
- With a School or Program, as described in Section 7.
- For legal reasons. We may disclose information if the law requires it, to respond to valid legal process, or to protect the safety, rights, or property of our users, the public, or Konita Games.
- Business changes. If Konita Games is involved in a merger, acquisition, or sale of assets, information may be transferred, and we will make sure the new owner honors this policy or we will give notice before your information is subject to a different one.
We do not sell personal information. We do not share personal information for advertising purposes.
6. Children's Privacy
The Service is designed for school-age children, and many Students are under 13. We take that responsibility seriously.
- How Students join. Students may join a class using a code provided by a Teacher or Program, or they may use the Service independently.
- Consent. For classroom use, we rely on the School or Program to provide any consent and notice required for Students' educational use of the Service, including consenting on Parents' behalf where the law allows it (see Section 7). For independent use, Student accounts collect only a first name, last initial, password, and the gameplay and technical information we use to operate the game, as the law allows. If we ever need to collect more personal information from a Student under 13, we will first obtain verifiable parental consent.
- What we collect. We collect only the information reasonably necessary to run the Service, as described in Section 2. We do not require a child to provide more information than needed to play.
- What we do not do. We do not show advertising to children, market to children, or allow children to chat with or publicly share information with other users.
- Parents' rights. A Parent may ask to review the personal information we hold about their child, ask us to delete it, and refuse to allow further collection or use of it. You can make these requests through your child's School or Program, or by contacting us (see Section 14). We may need to confirm that you are the child's Parent before we act.
If you think a child's information was collected in error, contact us and we will review it and delete it where appropriate.
7. Schools and Programs
If your School or Program has a separate written agreement with us, that agreement controls if it conflicts with this policy. Where student information counts as an education record under FERPA, and your agreement with us says so, we act as a “school official” with a legitimate educational interest and use that information only for the purposes described in that agreement and this policy.
A School or Program is responsible for having the authority to use the Service with its Students, for giving any required notice to Parents, and for obtaining any required consent. Programs that are not schools may have different legal obligations, and each is responsible for meeting its own.
8. Your Choices and Rights
You may ask us to:
- Give you a copy of the information we hold about an account.
- Correct information that is wrong.
- Delete an account and its information.
Make a request in the app (Settings > Data & Privacy) or by contacting us at support@dontbelategame.com. Requests are reviewed and completed by our team and may take several days. We may need to confirm your identity, or your authority over a Student's account, first, and we may keep some information where the law requires it. Depending on where you live, you may have additional privacy rights under local law, and we will honor them as required.
9. Data Retention
We keep information for as long as needed to provide the Service, meet legal obligations, and resolve disputes, and then delete or de-identify it. Deleting a class removes it and its roster from a Teacher's dashboard, but does not by itself delete Students' accounts or their gameplay history. Inactive accounts and classroom rosters with no activity for twenty-four (24) consecutive months may be permanently deleted from our active systems.
10. Security
We use reasonable measures to protect information, including secure sign-in through Firebase Authentication, encrypted (HTTPS) connections to our servers, and dashboards that show a Teacher only the Students in that Teacher's own classes. No system is perfectly secure, so please keep your login private and tell us right away at support@dontbelategame.com if you think someone else has used your account.
11. Where Information Is Stored
Information is stored on servers operated by our cloud provider (Firebase) in the United States. If you use the Service from outside the United States, your information will be transferred to and processed in the United States.
12. Third-Party Services
The Service depends on third-party services, such as your device's operating system (including its built-in text-to-speech), app stores, and the providers described in Section 5. Their own privacy policies apply to what they collect. We are not responsible for their practices.
13. Changes to This Policy
We may update this policy. For material changes we will give at least 30 days' notice by posting the new policy in the app with a new “Last Updated” date. If a change materially affects how we handle children's information, we will also give notice to Schools and Programs and, where the law requires it, seek new consent before applying the change to that information.
